1. Terms & Conditions

1.1 Introduction / Acceptance of Terms

Welcome to S&L Magic Creations (“we,” “us,” “our,” or the “Company”). These Terms & Conditions (“Terms”) govern your access to and use of our website, as well as any purchases you make from us, including but not limited to custom shirts, embroidery, laser-cut products, patches, and other personalized items (collectively, “Products”).

By visiting our website, placing an order, or otherwise engaging with our business, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must discontinue use of our website and services immediately.

These Terms constitute a legally binding agreement between you (the “Customer”) and S&L Magic Creations. We reserve the right to update or modify these Terms at any time, and your continued use of our website following any such changes constitutes your acceptance of the revised Terms.

1.2 Eligibility

Our website and services are intended for individuals who are at least 18 years of age. If you are under 18, you may only use our website and place orders with the express consent and active supervision of a parent or legal guardian, who will be considered the contracting party and will be responsible for all obligations under these Terms.

By using our website or placing an order, you represent and warrant that you are either (a) at least 18 years of age, or (b) using the website with verified parental or guardian consent. We reserve the right to refuse service, cancel orders, or terminate accounts at our sole discretion if we believe eligibility requirements have not been met.

1.3 Custom & Personalized Orders

S&L Magic Creations specializes in custom and personalized products. Because each item is made to order based on your specific instructions, artwork, text, dimensions, and/or design preferences, all custom and personalized orders are considered final sale and are generally not eligible for return or exchange, except as described in our Refund & Return Policy.

Customer Proofing Responsibility: Before production begins, we will provide a digital proof (“Proof”) of your custom order for review. It is the Customer’s sole responsibility to:

Review the Proof carefully for accuracy, including spelling, grammar, layout, sizing, colors, and all design elements.
Request any necessary corrections before approving the Proof.
Provide written approval (via email or our online approval system) before production commences.

Design Approval Process: Production will not begin until we have received your written approval of the Proof. Once you have approved the Proof in writing, S&L Magic Creations assumes no responsibility for any errors, omissions, or inaccuracies contained in the approved design. Any errors discovered after approval that are attributable to the Customer’s specifications will not entitle the Customer to a refund, remake, or credit.

1.4 Deposits & Payment

A deposit is required to initiate production on all custom orders. The deposit amount will be communicated to you at the time of order and will be specified in your order confirmation. The following terms apply to deposits and payments:

Deposits are non-refundable. Once a deposit is received, it covers the cost of design work, materials sourcing, and preparation — all of which begin immediately. No exceptions will be made to this policy.
The remaining balance due must be paid in full before your order is released for shipment or local pickup. We will not ship or release any order with an outstanding balance.
We accept payment via the methods listed on our website. All prices are stated in U.S. dollars. Applicable taxes, shipping fees, and handling charges will be disclosed at checkout.
In the event of non-payment of the remaining balance within the timeframe communicated by S&L Magic Creations, we reserve the right to cancel the order, retain the deposit, and dissolve the custom product at our discretion.

1.5 Production Timelines

Estimated production timelines are provided as a courtesy and are not guaranteed. Actual production time may vary based on order complexity, volume, current workload, material availability, and other factors.

Production begins only after both of the following conditions are met: (a) the required deposit has been received, and (b) the Customer has provided written Proof approval.
Delays caused by supply chain disruptions, material shortages, carrier issues, equipment downtime, or other circumstances beyond the reasonable control of S&L Magic Creations shall not constitute a breach of these Terms, and the Company shall not be liable for any resulting damages.
If a significant delay is anticipated, we will make reasonable efforts to notify the Customer.
Rush orders may be available at an additional charge, subject to current workload and feasibility. Rush availability is not guaranteed.

1.6 Intellectual Property

All original designs, artwork, graphics, logos, and creative content created by S&L Magic Creations are the exclusive intellectual property of the Company and are protected by applicable copyright, trademark, and other intellectual property laws.

Customer-Submitted Content: By submitting any artwork, logos, images, text, or design files to S&L Magic Creations, you grant us a limited, non-exclusive, royalty-free license to use that content solely for the purpose of fulfilling your order.
Customer Warranty: You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to use and submit any content provided to us, and that such use does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
Indemnification: You agree to indemnify and hold S&L Magic Creations harmless from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your breach of the above warranty.
S&L Magic Creations reserves the right to refuse any order that it reasonably believes involves infringing, offensive, or unlawful content.

1.7 Color Variation Disclaimer

S&L Magic Creations makes every effort to accurately represent our products and materials. However, Customers acknowledge and accept that color variations may occur between what is displayed on a digital screen and the final physical product. This is a normal and expected aspect of custom production and is not grounds for a refund or return.

Color variation may result from, but is not limited to, the following:

Differences in screen calibration, brightness, contrast, and color profile settings across devices.
Variation in embroidery thread dye lots between production runs.
Differences between vinyl color batches or heat transfer material grades.
Natural variation in laser engraving depth, intensity, and material reaction.
Fabric dye lots and substrate material composition affecting color absorption.

We strongly encourage Customers to request a physical sample or consult with our team prior to placing large orders if color accuracy is critical.

1.8 Limitation of Liability

To the fullest extent permitted by applicable law, S&L Magic Creations, its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to your use of our website or the purchase of our Products, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you actually paid to S&L Magic Creations for the specific order giving rise to the claim. Nothing in these Terms limits liability for fraud, gross negligence, or willful misconduct.

1.9 Dispute Resolution & Governing Law

These Terms and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

In the event of a dispute, we encourage Customers to first contact us directly at sales@slmagiccretions.com so that we may attempt to resolve the matter informally. If informal resolution is not achieved within thirty (30) days, either party may pursue resolution through binding arbitration or through the appropriate courts located in California, as applicable.

1.10 Changes to Terms

S&L Magic Creations reserves the right to modify, update, or replace these Terms at any time. Changes will be posted to our website with a revised “Last Updated” date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

2. Privacy Policy

3. Refund & Return Policy

3.1 Custom & Personalized Items

Because all of our products are made to order and customized specifically for each customer, all sales of custom and personalized items are final. We do not accept returns or exchanges on custom orders under ordinary circumstances.

Exceptions exist only when:

The item is defective due to a manufacturing or craftsmanship error on our part; or
The item we produced materially differs from the approved Proof due to an error made by S&L Magic Creations.

Dissatisfaction with the outcome of a correctly produced custom order — including color variation, subjective design preference, or a change of mind — does not qualify as grounds for a return or refund.

3.2 Non-Custom Items

In the event that S&L Magic Creations offers any non-custom, ready-made, or stock items for sale, the following terms apply:

Non-custom items may be eligible for an exchange or store credit within 14 days of the confirmed delivery date.
Items must be returned in their original, unworn and unwashed condition, with all original tags attached.
We do not issue cash refunds on non-custom items; only exchanges or store credit will be provided.
The customer is responsible for all return shipping costs.
Items that show signs of wear, washing, alteration, or damage will not be accepted.

3.3 Defective or Incorrect Items

If you believe you have received a defective item or an item that does not match your approved Proof due to our error, you must:

Contact us at sales@slmagiccretions.com within 5 business days of the confirmed delivery date.
Provide your order number, a clear description of the issue, and photographic evidence of the defect or discrepancy.

Upon review and confirmation of the issue, S&L Magic Creations will, at its sole discretion, either:

Remake the item at no additional cost to the Customer; or
Issue a full or partial refund to the original payment method.

Claims submitted after the 5-business-day window, or without adequate photographic documentation, may not be honored.

3.4 Order Cancellations

We understand that circumstances change. The following cancellation terms apply:

Cancellations are accepted only before production has begun. To cancel an order, you must notify us in writing at sales@slmagiccretions.com as soon as possible.
Deposits are non-refundable under any cancellation scenario, as they cover the cost of work already performed (design, sourcing, setup, etc.).
If production has already begun at the time a cancellation request is received, no cancellation will be accepted, and the remaining balance will remain due.
“Production has begun” includes, but is not limited to, the ordering of materials, preparation of machinery, digitizing of embroidery files, and the commencement of any physical production work.

3.5 Refund Processing

Approved refunds will be issued to the original payment method used at the time of purchase. Refunds are typically processed within 5 to 10 business days from the date of approval. Please note that your financial institution may require additional time to reflect the refund in your account. S&L Magic Creations is not responsible for delays imposed by your bank or payment processor.

3.6 Color & Design Variation

As outlined in our Color Variation Disclaimer (Disclaimers, Section 5), variations in color between your digital design or screen display and the finished physical product are not considered defects and are not grounds for a return, remake, or refund. By approving your Proof and placing your order, you acknowledge and accept this inherent aspect of custom production.

4. Shipping Policy

4.1 Processing & Production Time

Production time and shipping time are separate and distinct. Production time refers to the time required to create your custom order, while shipping time refers to the transit time after your order has been completed and handed to the carrier.

Orders are processed and production is initiated only after both of the following have been received:

Full deposit payment (as outlined in our Terms & Conditions), and
Written Customer approval of the digital Proof.

Typical production time is estimated at 7 to 21 business days, depending on the complexity of the order, quantity, and current production workload. More complex orders involving multi-layer embroidery, large quantities, intricate laser cutting, or special materials may require additional production time. We will communicate estimated timelines at the time your order is placed.

4.2 Shipping Timeframes

Once your order has been completed and packaged, it will be shipped via our selected carrier. Estimated domestic shipping timeframes are as follows:

These are carrier-estimated timeframes and are not guaranteed by S&L Magic Creations. S&L Magic Creations currently ships within the United States only. International shipping is not available unless explicitly stated at the time of purchase. Additional shipping charges may apply based on package weight, dimensions, and destination.

4.3 Shipping Carriers

S&L Magic Creations ships using one or more of the following carriers, at our discretion based on your location, order weight, and availability:

United States Postal Service (USPS)
United Parcel Service (UPS)
FedEx
Other comparable carriers as needed

We reserve the right to select the most appropriate carrier for each shipment. If you have a carrier preference, please notify us at the time of ordering, and we will do our best to accommodate your request, though it cannot be guaranteed.

4.4 Tracking Information

Where available, tracking information will be provided to you via email once your order has been shipped. Please allow up to 24 hours after your tracking number is issued for the carrier’s system to update with shipment status. If you have not received tracking information within 2 business days of your expected ship date, please contact us at sales@slmagiccretions.com.

4.5 Lost or Damaged Shipments

S&L Magic Creations is not responsible for packages lost, stolen, or damaged in transit once they have been accepted and scanned by the carrier. However, we understand how frustrating these situations can be, and we will do our best to assist you.

In the event of a lost or damaged shipment, the Customer is encouraged to file a claim directly with the carrier, as the carrier bears responsibility for packages in its custody.
S&L Magic Creations will cooperate in providing documentation, receipts, and information needed to support a carrier claim.
If insurance was purchased at the time of shipment and a valid claim is filed and approved, any carrier-issued reimbursement will be passed on to the Customer.

4.6 Address Accuracy

It is the Customer’s sole responsibility to ensure that the shipping address provided at the time of ordering is accurate and complete, including apartment/suite numbers, ZIP codes, and any special delivery instructions. S&L Magic Creations will ship to the address provided and is not responsible for:

Packages returned as undeliverable due to an incorrect or incomplete address.
Packages delivered to the wrong address due to Customer error.
Additional shipping charges required to reship an order due to address error.

If a package is returned to us due to an undeliverable address, we will contact you to arrange reshipment at your expense.

4.7 Holiday & Peak Season Delays

During holiday periods (including but not limited to Thanksgiving, Christmas, New Year’s, Valentine’s Day, and Mother’s Day) and other peak seasons, production and shipping timelines may be extended. We strongly encourage Customers to place orders well in advance of any event or date-sensitive deadline. S&L Magic Creations will make reasonable efforts to communicate known delays, but we cannot guarantee on-time delivery during peak periods and will not be held liable for carrier delays.

4.8 Local Pickup

Local pickup may be available as an option for Customers in our area. If local pickup is offered, it will be noted during the checkout process or upon request. Customers selecting local pickup will be notified via email when their order is ready. Orders not picked up within a reasonable timeframe (typically 14 calendar days after notification) may be subject to cancellation or a storage fee at our discretion. 5. Disclaimers

5.1 No Warranty Disclaimer

All products offered by S&L Magic Creations are sold “as is” with respect to the Customer’s custom specifications. While we take pride in our craftsmanship and stand behind the quality of our work, we make no express or implied warranties regarding the fitness of any product for a particular purpose beyond its stated function as a custom-made item.

To the extent permitted by applicable law, S&L Magic Creations expressly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Our liability, where applicable, is limited as set forth in the Terms & Conditions, Section 1.8.

5.2 Color Variation Disclaimer

S&L Magic Creations makes every reasonable effort to produce items that are consistent with the approved digital Proof. However, color variation between digital representations and physical finished products is normal and expected. The following factors contribute to color variation and are not considered defects or errors:

Screen Calibration Differences: Computer monitors, tablets, and smartphones each display color differently depending on calibration, brightness settings, color profiles, and screen technology. The color you see on your device may not be a precise representation of the physical product.
Embroidery Thread Dye Lots: Embroidery thread colors can vary between manufacturing dye lots. Even threads ordered from the same supplier in the same color code may have subtle shade differences.
Vinyl Color Batches: Heat transfer vinyl and adhesive vinyl are produced in batches, and color consistency across batches is not guaranteed by vinyl manufacturers.
Laser Engraving Material Variation: Laser engraving results vary significantly based on the specific material being engraved — including its density, finish, coating, and color — and the intensity and speed settings used during production.
Fabric Dye Lots and Composition: The base garment or substrate material’s dye lot, fiber content, and surface finish can affect how inks, dyes, and applied materials appear on the final product.

By approving the digital Proof and proceeding with your order, you acknowledge and accept the possibility of color variation as described above.

5.3 Design Accuracy Disclaimer

The Customer is solely responsible for the accuracy of all content included in the custom order, including but not limited to:

Spelling, grammar, and punctuation of all text elements.
Names, dates, numbers, and other specific details.
Layout, sizing, and positioning of design elements.
Any other content or information included in the submitted design or order instructions.

S&L Magic Creations will produce the item exactly as approved in the final Proof. Once a Proof has been approved in writing by the Customer, S&L Magic Creations assumes no responsibility for any errors, typos, misspellings, or inaccuracies present in the approved design. No refund, remake, or credit will be provided for errors in Customer-approved content.

5.4 Results Disclaimer

Due to the inherently custom nature of our products, results may vary from order to order, even when using the same design on similar items. Variation in final results can be influenced by:

The type and weight of the garment or substrate.
The fiber content and weave of fabric (e.g., polyester, cotton, blends).
Thread color selections and their interaction with background material colors.
The specific laser material type, thickness, and finish.
Application techniques and equipment tolerances.

We encourage Customers with questions about expected results for a specific product type or material to contact us before placing an order.

5.5 Third-Party Content

S&L Magic Creations does not independently verify the intellectual property rights of content submitted by Customers. By submitting any logos, images, artwork, or other content to us, the Customer warrants and represents that:

They own the submitted content outright, or have obtained all necessary licenses and permissions for its use in a commercial or personal custom product; and
The use of such content does not infringe upon the copyright, trademark, or other intellectual property rights of any third party.

S&L Magic Creations reserves the right to refuse any order involving content that we reasonably believe may be infringing. The Customer agrees to indemnify and hold S&L Magic Creations harmless from any claims arising from third-party content submitted by the Customer.

5.6 Care Instructions

To maintain the quality and longevity of your custom product, it is essential to follow appropriate care instructions. Improper care or washing will void any quality claim relating to the durability of embroidery, heat transfer, print, or other applied decoration.

General care guidelines include:

Turn garments inside out before washing.
Wash in cold water on a gentle cycle.
Do not bleach or use harsh detergents.
Tumble dry on low heat or hang to dry.
Do not iron directly over embroidery, vinyl, or heat transfer decorations.
Follow any specific care instructions provided with your order.

S&L Magic Creations is not responsible for damage to products resulting from improper care, laundering, storage, or use inconsistent with the nature of the product.
